Definitions and acceptance of AvaiBook Dynamic Terms and Conditions:
The following terms and conditions of the AvaiBook Dynamic Pricing Tool (here in after "AvaiBook Dynamic Pricing Terms and Conditions") regulate the terms under which AvaiBook on-line S.L., a Spanish company with registered office at c/ Bari 31, Ed. Technocenter Alpha Suite 002. 50197 Zaragoza (SPAIN), registered in the Commercial Register of Zaragoza (SPAIN), volume 3774, book 0, folio 119, page 119, sheet Z50074, dated 26/04/2010 - NIF: ES-B99279622 (hereinafter “AvaiBook”) offers its customers (hereinafter “User”) an intelligent pricing tool (hereinafter “AvaiBook Dynamic Pricing Tool”) that provides price recommendations for specific listings.
The AvaiBook Dynamic Pricing Tool is subject to these AvaiBook Dynamic Pricing Terms and Conditions, and in all matters not expressly regulated herein, to the General Conditions of Use and Legal Notice published at all times on the website www.AvaiBook.com.
AvaiBook reserves at all times the right to update, extend, or modify, by any means admissible by law, the AvaiBook Dynamic Pricing Terms and Conditions, and shall endeavor to notify the User.
Please read these AvaiBook Dynamic Pricing Terms and Conditions carefully and familiarize yourself with them before using the AvaiBook Dynamic Pricing Tool.
By requesting and using the AvaiBook Dynamic Pricing Tool, it is understood that the User has read, understands, and expressly accepts all the terms set forth in the AvaiBook Dynamic Pricing Terms and Conditions. The access and the use of the site’s AvaiBook Dynamic Pricing Tool is under the sole and exclusive responsibility of the User. If the User does not agree with the AvaiBook Dynamic Pricing Terms and Conditions or any modifications that may be made to them, the User must stop using the AvaiBook Dynamic Pricing Tool. By continuing to use the Tool, the User accepts the AvaiBook Dynamic Pricing Terms and Conditions.
AvaiBook Dynamic Pricing Tool Description
AVAIBOOK makes available to the User the AvaiBook Dynamic Pricing Tool, which provides pricing recommendations for specific User listings to help Users maximize their revenue. The price recommendation is made taking into account a set of variables, such as the market, the area where the listing is located, possible competition, traveler demand, seasonality, or advance bookings.
These recommendations may be applied manually or automatically on specific AvaiBook rates, and thus have an effect on the sales channels through the Booking Engine and the Channel Manager.
The AvaiBook Dynamic Pricing Tool is available for specific listings on any AvaiBook plan and is integrated within the all-in-one solution offered by AvaiBook. It requires an additional contract and therefore has an added cost to the subscription plan that the User has signed up for.
This AvaiBook Dynamic pricing solution has been developed with technology from AirDNA (hereinafter "Partner"), a leading provider of data and analytics for the short-term rental industry.
Our Partner offers its technology and knowledge in short-term rentals, and in order to make use of it, the listing must be connected via XML with Airbnb through the AvaiBook Channel Manager. Otherwise, the AvaiBook Dynamic Pricing Tool cannot be used.
Fees, activation, renewal, and cancellation of the AvaiBook Dynamic Pricing Tool
Pre-requisites for activation:
The User must have an active subscription to any of the plans offered by AvaiBook and no unpaid fees associated with it. The User understands and accepts that having unpaid invoices, for any reason, may result in the immediate cancellation of the AvaiBook Dynamic Pricing Tool.
Any User may activate the AvaiBook Dynamic Pricing Tool regardless of the plan they are subscribed to in any of its versions: trial, free, special, basic, advanced, premium, leader, standard, or pro.
Trial Period:
The first time the AvaiBook Dynamic Pricing Tool is activated, it will be free for a maximum period of 30 days for all supported listings. At the end of this trial period, the service will be renewed at the current price and taking into account all the listings that are active at that time in the AvaiBook Dynamic Pricing Tool.
Activation, fees and renewal:
The activation of the AvaiBook Dynamic Pricing Tool involves an additional cost to the plan the User is subscribed to. This cost will depend on the number of listings the User has active at the time of renewal after the trial period ends, or subsequent monthly renewals of the AvaiBook Dynamic Pricing Tool.
The subscription to the AvaiBook Dynamic Pricing Tool is self-manageable, so that the User may activate or disconnect their listings. They need to save the changes made so that they take effect on the renewal date of the AvaiBook Dynamic Pricing Tool. In any case, the subscription will be on a monthly basis, i.e. every 30 days from the end date of the trial period.
As soon as the User activates a listing, they may start using the AvaiBook Dynamic Pricing Tool from that moment on. The payment for this new listing will be made on the date indicated as "next renewal", which is the same for all listings.
The rate chart is calculated based on the number of active listings and an automatic discount is applied based on the volume of active listings. The monthly cost of the AvaiBook Dynamic Pricing Tool is shown in the following applicable rates:

AvaiBook reserves the right to revise its rates and conditions of the AvaiBook Dynamic Pricing Tool and will notify the customer by e-mail to the e-mail address provided prior to the next renewal date.
The published AvaiBook Dynamic Pricing Tool rates do not include taxes, unless otherwise specified.
Renewal takes place on a monthly basis. On the renewal date, the fee will be charged per the payment method configured in AvaiBook and an invoice will be issued for this service. The renewal date will always be visible in the "subscription" section.
Cancellation:
To unsubscribe from the AvaiBook Dynamic Pricing Tool, all listings must be deactivated and the changes saved so that the service is not renewed. Once the cancellation has been confirmed, the AvaiBook Dynamic Pricing Tool can be used for the days remaining until the next renewal, at which time the AvaiBook Dynamic Pricing Tool will be effectively CANCELLED.
The User may reactivate their AvaiBook Dynamic Pricing Tool subscription at any time by simply activating one of the listings and saving the changes made.
Notwithstanding the above, when a listing is disconnected, it cannot be activated until 30 days after the disconnection date (this does not apply during the 30-day free trial).
Liabilities, guarantees, and legislation
The User agrees to pay the agreed upon fees as accepted in the AvaiBook Dynamic Pricing Terms and Conditions; and to act in accordance with the applicable regulations in force.
The User understands and accepts that AvaiBook is limited to giving the User access, by subscribing to the AvaiBook Dynamic Pricing Tool, to the recommended pricing information provided to AvaiBook by its Partner's technology. Consequently, AvaiBook makes no guarantee, express or implied, that the prices recommended by the AvaiBook Dynamic Pricing Tool are optimal for each listing and, therefore, AvaiBook is not responsible and shall not be liable for the veracity, accuracy, timeliness, quality, or usefulness of such information.
Furthermore, the User understands and accepts that they are solely responsible for evaluating the prices recommended by the AvaiBook Dynamic Pricing Tool and, if necessary, implementing the recommended prices in their rates in the most appropriate way under their responsibility. In this regard, the User understands that the AvaiBook Dynamic Pricing Tool is intended to assist in making decisions on the pricing strategy for a listing, there being many other factors that the User must take into account. Therefore, AvaiBook recommends that the User make prudent use of the recommended prices. If applicable, the User shall not hold AvaiBook liable for any claim, demand, or complaint regarding third parties, which may arise from any breach.
In order to facilitate improvements or other adjustments to the AvaiBook Dynamic Pricing Tool, our Partner may without advance notice to AvaiBook or the User conduct service outages or maintenance of the AvaiBook Dynamic Pricing Tool at specific times. Consequently, the User accepts that AvaiBook shall not be liable for such circumstances.
Any breach by either party of the obligations set forth in these AvaiBook Dynamic Pricing Terms and Conditions shall entail the compensation of damages caused to the other party, regardless of the right to terminate the contractual relationship.
In any case, the parties agree that the maximum liability of AvaiBook arising from any breach of the contractual relationship shall be limited to the amount paid by the User in a monthly payment, without exceeding that amount.
